Please read these Terms of Service ("Terms", "Agreement") carefully before using the Artifly AI service ("Service", "us", "we", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Description of Service

Artifly AI provides artificial intelligence tools that allow users to generate images, illustrations, and visual assets based on text descriptions ("prompts") or social media post texts.

2. User Accounts

To access certain features of the Service, you may be required to register for an account. By registering, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and accept all risks of unauthorized access to your account.
• Be at least 18 years of age (or the age of legal majority in your jurisdiction).

3. Content and Intellectual Property

3.1. Your Input

You retain all rights to the text, images, or other data you upload or submit to Artifly AI ("Input"). You represent and warrant that you own the Input or have the necessary rights to use it without infringing on the rights of any third party.

3.2. Generated Content (Output)

Subject to your compliance with these Terms and your subscription plan:

• Free Plan: Artifly AI retains ownership of the generated images. We grant you a limited, non-exclusive, non-transferable license to use the images for personal, non-commercial purposes only.
• Paid/Pro Plan: You own all right, title, and interest in and to the images generated by the Service during your paid subscription period, including the right to use them for commercial purposes.

3.3. License to Artifly AI

You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your Input and Generated Content solely for the purposes of operating, improving, and promoting the Service (e.g., showcasing capabilities in a gallery), unless you have opted out via specific privacy settings (if available).

4. Prohibited Use

You agree not to use the Service to generate content that:

• Violates any applicable national or international law.
• Is pornographic, sexually explicit, or depicts non-consensual sexual content.
• Promotes violence, hate speech, discrimination, or harassment.
• Infringes upon the intellectual property or privacy rights of others (including creating "deepfakes" of real people without consent).

We reserve the right to suspend or terminate your account immediately if you violate these rules.

5. Payment, Subscriptions, and Refunds

Billing: Services are billed on a subscription basis or per-generation basis as described on our pricing page.

No Refunds: Due to the high computing costs associated with AI generation, all payments are non-refundable, except where required by law.

Cancellation: You may cancel your subscription at any time. You will continue to have access to the Service through the end of your current billing period.

6. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

Accuracy: We do not guarantee that the generated images will be accurate, unique, or meet your specific requirements. AI models may occasionally produce artifacts or nonsensical text.

Similarity: Due to the nature of generative AI, different users may receive similar outputs for similar prompts.

7. Limitation of Liability

To the maximum extent permitted by law, Artifly AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Insert Country, e.g., The Netherlands], without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
